Privacy Policy

These terms apply whenever we register, renew or manage a domain name for you. They apply in addition to our other terms (such as our Hosting Terms & Conditions, where relevant). By asking us to register or renew a domain name, you agree to these terms. In these terms, "we", "us" and "our" mean Media Street Limited, and "you" means the customer for whom the domain is registered (the registrant). We provide domain services to business customers only; by asking us to register or renew a domain, you confirm that you are acting in the course of business and not as a consumer.

1) Registry and registrar rules

1. Domain names are not provided by us alone. Each domain is registered through a registry (the body responsible for that domain ending) and a registrar, and is subject to their rules and to the policies of ICANN (the international body that oversees the domain name system).
2. By asking us to register or renew a domain, you agree to be bound by the applicable registry and registrar terms, including:
   • for .uk domains, Nominet's Terms and Conditions of Domain Name Registration and its rules and dispute resolution service (DRS) policy; and
   • for other domains (such as .com, .net and .org), the registrar's registrant agreement and the policies of the relevant registry and ICANN.
3. We will make these terms available to you, or tell you where to find them, before registration. The current versions are published by the relevant registry and registrar. If there is any conflict between these terms and the rules of a registry, registrar or ICANN, those rules will prevail.

2) Registering a domain

1. We will use reasonable efforts to register or renew the domain name you request, but we cannot guarantee that a domain will be available, or that a registry will accept or maintain a registration, even if it appeared available when you asked for it.
2. A domain is only registered once you are recorded as the registrant on the relevant registry's records. We are not responsible if a registry refuses, suspends, cancels or revokes a registration.
3. A domain name is not owned in the way physical property is; your rights are those given by the registration and the applicable registry rules.

3) Your contact details and accuracy

1. You must provide complete and accurate registrant contact details, and you must keep them up to date. You must respond promptly to any request from us, a registrar or a registry to confirm or correct those details.
2. Providing inaccurate or out-of-date details, or failing to respond to a verification request, is a serious matter and may result in your domain being suspended or cancelled by the registry or registrar. We are not responsible for any suspension or cancellation that results.

4) Your responsibilities and warranties

1. You confirm that you are entitled to register and use the domain name, that doing so does not infringe anyone else's rights (including trademarks), and that you will not use the domain for any unlawful purpose.
2. If you are registering or managing a domain whose registrant or contact details relate to another person, you confirm that you have informed that person and have their consent to those details being used and disclosed as described in these terms.
3. You will be responsible for, and indemnify us against, any claims, losses or costs arising from your registration or use of a domain name in breach of these terms or of any registry, registrar or ICANN rules.

5) Disputes

1. You are bound by the dispute resolution policies that apply to your domain — for .uk domains, Nominet's DRS policy, and for other domains, ICANN's Uniform Domain Name Dispute Resolution Policy (UDRP) and Uniform Rapid Suspension (URS) system.
2. If a domain becomes the subject of a dispute or legal proceedings, the registry or registrar may suspend, lock or transfer it in accordance with those policies, and we may be required to act on their instructions.

6) Personal data and public records

1. Registering a domain involves sharing the registrant's contact details with the relevant registrar, registry and ICANN, and these may be archived with a third-party escrow service, in each case under their own rules. These bodies act as independent controllers of that data.
2. Most personal data is no longer shown in public domain lookups (WHOIS/RDAP), but some information may be displayed or disclosed where the rules require it. Our own handling of your personal data is described in our Privacy Policy.

7) Renewals and expiry

1. Domain names are registered for a fixed term and must be renewed to keep them. We will try to send you renewal reminders before the renewal date, but it is ultimately your responsibility to ensure a domain is renewed in time.
2. Unless you tell us in good time that you do not wish to renew, we may renew the domain on your behalf and charge you the applicable renewal fee.
3. If a domain is not renewed in time, it will expire, will stop working, and may be subject to a redemption or grace period during which additional fees apply to recover it. After that, it may be released for others to register, and we cannot guarantee it can be recovered.

8) Fees

1. Domain registration and renewal fees are payable in advance. Because we pay the registry and registrar on your behalf at the point of registration or renewal, domain fees are non-refundable, even if the domain is later suspended, cancelled or transferred.

9) Transfers

1. If you wish to transfer a domain to another registrar or to another person, this must be done using the published transfer process for that domain. Any person taking over a domain from you must agree to the applicable registry and registrar terms.
2. You authorise us to take the steps reasonably necessary to give effect to a valid transfer request.

10) Our authority to act for you

1. You authorise us to register, renew, manage and (where you ask us to) transfer domain names on your behalf, and to submit the information and accept, as your agent, any registry or registrar registrant terms that are required to do so.
2. You should contact us first with any request or question about a domain we manage for you.

11) Our liability

1. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under English law.
2. Subject to clause 11.1, we will not be liable for any loss of profits, revenue, business, anticipated savings, goodwill or data, or for any indirect or consequential loss, whether arising in contract, tort (including negligence) or otherwise.
3. Subject to clause 11.1, our total liability to you under or in connection with these terms will not exceed the total fees you have paid us for the domain name(s) giving rise to the claim in the 12 months before the event giving rise to the liability.
4. You acknowledge that the registries, registrars and ICANN limit their own liability under their respective terms, and that we are not responsible for their acts, omissions or decisions.

12) Changes, governing law and contact

1. We may update these terms from time to time by publishing a new version. The version that applies is the one in force when you register or renew a domain.
2. These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with them. (The registry and registrar terms you agree to may be governed by other laws.)
